May an employer ask an employee or an applicant if they are pregnant or if they intend to become pregnant soon?

No, they may not. Because of the Pregnancy Discrimination Act, employers may not treat current or prospective employees unfairly because of pregnancy, childbirth or related condition. They may never ask if they are or plan to become pregnant.

Questions about a prospective employee’s pregnancy or desire to become pregnant may also not be asked during the interview process. Employers cannot ask employees these questions even if there are suspicions or rumors regarding a pregnancy.
